President Trump nominates Neil Gorsuch for Supreme Court vacancy

Doesn’t matter if the committee endorses the nominee – all Supreme Court nominations go to the Senate for a vote. “This is a stolen seat”, the OR senator told Politico in an interview Monday. Democrats will be hard-pressed to stop the nomination given the 52-48 advantage Republicans hold in the Senate.

Even as a minority party, they can block Gorsuch: according to Senate rules, a Supreme Court nomination can still require 60 of 100 votes if a filibuster is used.

Meanwhile, Gorsuch was accompanied by Vice President Mike Pence as he met with Senate Majority Leader Mitch McConnell. “I would say it’s up to Mitch, but I would say go for it”.

Things that would argue for his approval would be his impeccable academic resume at elite universities in America and overseas, his humble demeanor, and his work at Denver’s U.S. 10th Circuit Court of Appeals, where he now serves. And Obama’s former acting solicitor general, Neal Katyal, praised Gorsuch: “I have no doubt that if confirmed, Judge Gorsuch would help to restore confidence in the rule of law”, he wrote in the New York Times.

Former Democrat presidential contender Bernie Sanders said Judge Gorsuch “must explain his hostility to women’s rights, support of corporations over workers and opposition to campaign finance reform”.

The nuclear option is a procedural move to overwrite a Senate rule with 51 votes, essentially eliminating any efforts of the minority party to filibuster. Though they left it in place elsewhere, including for Supreme Court nominations, the precedent for change was set, and the ball set in motion.

Manchin also weighed in on Trump’s executive order to temporality ban refugees from seven predominately Muslim countries.

Trump announced his choice from a list of contenders that also included 3rd U.S. Circuit Judge Thomas Hardiman and 11th U.S. Circuit Judge William Pryor Jr.

Senators Ted Cruz and Chuck Grassley, the chairman of the Senate Judiciary Committee, both touted Gorsuch as a judge who adheres to a strict interpretation of the Constitution common among conservative judges. “I look forward to seeing Judge Gorsuch confirmed by the Senate as soon as possible”.

On the one hand, a yes vote would upset Democrats who remain furious at Republicans for refusing to consider Merrick Garland, President Barack Obama’s choice for the vacancy, after Scalia’s unexpected death last February.

Outside groups say they want Democrats to utilize the filibuster if needed to keep Gorsuch off the court.

Several Supreme Court justices could well retire or die during the next several years.

In a recent lecture at Case Western Reserve University, Gorsuch called the late Scalia a “lion of the law”.

“We Democrats will insist on a rigorous but fair process”, Schumer said in a speech on the Senate floor.
