DOJ Docs Raise Questions About Gorsuch’s Views on Torture and Executive Power

Tenth Circuit Judge Neil Gorsuch’s nomination to the U.S. Supreme Court faces its most public test starting Monday, when he faces the Senate Judiciary Committee for the start of what could be an nearly weeklong confirmation hearing. The hearings are expected to end Thursday.

Monday’s session, which will begin at 11 a.m., will consist entirely of opening statements by senators.

Blumenthal said he would be looking at Gorsuch’s demeanor and his credibility as he answers the committee’s questions. The Senate Judiciary Committee is to take up his nomination on Monday. Requiring more of Congress is unrealistic, and letting courts freeze the meaning of ambiguous terms like “pollutant” through judicial interpretation means that Congress’ policy goals will be frustrated when times or scientific knowledge change. The best they could come up with is that Gorsuch and some executives at Anschutz’s companies chose to go in together on buying a vacation house.

Senate Democrats have indeed pledged to probe every aspect of Gorsuch’s background and views.

Other JCN ads tout Gorsuch’s credentials, and friends of the nominee said he is prepared to face the tough questioning of senators.

“There’s a little bit of me that’s hoping we’ll have the last laugh against Trump and the people who presented Gorsuch as though he’s in their pocket and going to rubber stamp the political and social agendas they want to promote”, said Laura Lichter, a Denver lawyer whose immigrant client won an appeal before Judge Gorsuch in 2015.

“The qualifications of Judge Gorsuch are beyond dispute”.

However, the DSCC Chair, Maryland’s Chris Van Hollen, this week said, “We’ve been really clear that you need to meet the 60-vote standard…” They say he has failed to distance himself from President Donald Trump’s attacks on judges, that he can not be trusted to rein in executive power and that his jurisprudence is skewed toward business interests. As the letter noted, the Supreme Court ruled more narrowly, allowing corporations that are run by a small number of people – where the owners are indistinguishable from the company they run – can opt out of Obamacare mandates based on their religious objections. “I could be wrong, though, because [the] Democratic base is furious and may demand that the Democrats go after Gorsuch with everything they’ve got”. There they displayed over a million signatures of people opposed to Gorsuch’s nomination.

Roberts spoke just weeks before the death of Justice Antonin Scalia. For the health of our democracy now is the time for these legislators to put duty and patriotism before partisanship, to reject extremism and to stand against a lifetime appointment of a right-wing judge to the U.S. Supreme Court.

The House Democrats’ letter pointed to poll results indicating that 90 percent of voters believed a new Supreme Court justice should “be open to limiting the influence of big money in our politics”.

The opinion suggests Judge Gorsuch’s disposition “to resist overweening exercises of executive power”, said Michael W. McConnell, a professor at Stanford Law School. He wrote separately, however, to say that making a political contribution was a “fundamental” right deserving the highest level of constitutional protection, known as “strict scrutiny review”.
